UHC to UHC

I have UHC with my husband's company and they have an exclusion in their policy against GP surgery. I can get UHC with my company and they DO NOT have an exclusion in fact they say they cover it. HOWEVER, my husbands insurance has better coverage. WELL, my really question I am needing help on is--- I just had my request for the surgery denied through UHC (my husbands company)- but I can CHANGE to my UHC (through my company who does not exclude it)--- will UHC still deny me again because I am just switching companies?

They can not deny you based on your previous coverage under your husbands policy. You don't actually have to drop your coverage with your husbands policy at all, just pick up yours in addition to. It will become your prime coverage and your husbands will be secondary. In some cases the secondary coverage will pick up what the primary does not pay (deductible, copay, coinsurance) even if they would have denied the procedure to begin with. Then, once you have your surgery, you can drop your coverage and just go with your husbands again. The only problem with this is that you may need to wait until open enrollment to do this. In order to change insurance stuff not within that time frame you need to have a 'qualifying change' in your status. see this link for information regarding your insurance rights. http://www.cms.hhs.gov/hipaa/hipaa1/default.asp Unless you have had a break in coverage in the last 18 months, you will not have to deal with the pre-existing clause whatsoever.
