Denied due to pre-existing exclusion

BC/BS of Alabama has denied me because I have a pre-existin exclusion on my policy until 4/04. However when I read the insurance contract it defines "pre-existing" as a condition for whom you have sought or received care or treatment for in the 6 month period prior to your contract date. I seriously don't believe that should apply to me because I did NOT seek or receive any care for treatment of obesity prior to my contract date, because they would not have covered it anyway becuase it is weight-related. I've appealed, and they seem to indicate they will cover after April, I've just waited so long all ready. Have all my pre-op testing done. I'm ready! Let me know if you have any suggestions or similar cases.
