Insurance company has denied my approval

I am appealing my denial for the gastric bypass procedure. I feel that my not getting approved was an administrative error versus non medical neccesity. On April 7, 2003 my provider sent in all of the requirements that were requested by the insurance company. On April 29, a letter was sent to me stating, " in light of a recent legal interpretation, bariatric surgery will no longer be covered by Coventry." The decision was made by the insurance carrier on April 28, 2003. My providers office says they didn't receive the letter from my doctors office because it was sent to the wrong office. My provider was not aware of this until she inquired about my request for surgery. When she inquired she was informed of the receipt, but incorrectly sent it to the wrong office. Now, my concern is that all of my paperwork was in before Coventry's decision to stop performing the procedure. My provider's office has documented everything. I am appealing ecause I believe that Coventry was aware of this upcoming decison to no perform the bypass procedure anymore and sat on my paperwork. In addition, I called my HMO to find out what doctor was approved and they gave me three doctors in Gerogia. I want to know how to fight this. I now have approximately 2 and one half months, October 29, 2003 to fight this decison. I firmly believe that this is an adminstrative decison versus medical neccessity because Coventry addressed my not being approved based on time and dates. I am having trouble composing this letter of appeal. My doctor has already written their appeal and we have decided to send both of our appeals together. Does this explanation of what is happening to me a good letter to send to my insurance company? I would appreciate any imput, because physically and mentally I qualify for the gastric bypass procedure.

Lisa, I think your letter sounds good and I would send it in. If you again get denied I would for sure go to obesitylaw.com and hire Walter. Dont let them get away with doing that to you. Best of luck to you
