BCBS of MD and approval. HELP!!!

Hi all,

New to this site.  I have BCBS and my employer is considered a small business so the Maryland law mandating that insurers provided coverage for morbid obesity does not apply to them.  I am pretty sure it is also excluded on the contract.  In fact I was told that no small business is even offered the option to get the coverage for WLS.  Now I have been doing a lot of reading and during my search of the law I found one article that said that even though it is excluded and not mandated because it is small business insurance that they still might cover if medically necessary.  My question is if I can provide a good case of medical necessity is there a chance of getting it covered.  I have had breast cancer, I have asthma, acid reflux, herniated discs in my lower back, BMI of 46.5, and I am pretty sure i have sleep apnea. 

Has anyone ever heard of a small business insurance that excludes the surgery covering it because of medical necessity??  Is it worth just seeing if I can get a pre-auth.  I do not have the six months of diet plan complete or the psy visit done yet.  Can I meet with a surgeon and they send a medical necessity plea to my insurance and it possibly work?
