Appeal - Indiana State Law

My appeal was denied because I have not had a BMI of 40 for 5 years. However, I have had a BMI of 35 with co-morbitities for 5 years and I thought that Indiana State Law considered that morbidly obese. Does anyone know if I have a case? Should I hire an attorney and appeal again based on this only???

Are they serious co-morbids? Heart disease, diabetes, sleep apnea...? How long have you been over 40 exactly?

Two things I would suggest:
1) Take your info to the light weight forum - these people know what it is like to fight for insurance coverage when your "not fat enough."
2) If you want to increase your odds of winning, consider hiring the guys at obesitylaw.com - they know their stuff and can make your appeal stronger.
