Suing co over exclusion

I've read about a few people who hired an attorney to get the insurance co to pay for the surgery.  Has anyone ever gotten ins to cover it when the co has an exclusion against bariatric surgery?

Exclusions usually have to be faught at the employer level. They are the ones that either wrote the exclusion, or decided to buy the plan that includes an exclusion (or conversly, excludes the WLS surgery).

Sometimes, if the employer is small (under 100 people), they had no choice. The insurance companies only sell limited coverage to small companies, period.

Thanks so much for that information. I know that my company currently has a plan with exclusion and I have been thinking about whether or not HR might be of assistance. What the heck, it can't hurt to try it--- and your story is an inspiration.
