Exclusions - Give up or fight?

I've read and been told there is NO way to fight an exclusion, then see some that claim you should! What is the story? Has anyone successfully fought an exclusion? Are their legal precedents? I also see some that it's covered under the ADA, and others say court decisions say it isn't.
