Employer is trying to intefere with my right for medical leave!
I submitted my request for medical leave on Monday 11/26. On Thursday, my employer, who is based out of SC met with me in Greensboro and all but asked me to quit. The VP of sales told me that he no longer felt like I was happy with my job. He also told me how easily replaceable I was and so forth. The meeting was groundless and I afterwards I immediately filed a formal complaint with my HR dept. To make a long story short we are now at a standstill until Monday at which time they want me to give them an answer as to whether I am going to go or stay.
Does anyone know a good employment attorney who can help me? Any help would be greatly appreciated!!!! I think I have a clear case of my employer interfering with my right to medical leave (oh by the way, HR claims they have lost my application for STD indurance which I submitted over two months ago!)
I'm not an attorney, but I would recommend telling them that you will be obtaining the services of one.
There are laws to protect you, especially when it comes to medical leave (Family & Medical Leave Act). Your employer is bound both by the laws where their company is based, and in most cases, also by employment laws where you are located. Again, contact an attorney - - and tell your employer that they give you no choice but to do so - - and I bet they will think twice before threatening you like that again. The board of labor relations folks in my state are "pit bulls" from what I've heard. Once they go after an employer for unfair treatment, they don't let go.

I know this is a tardy reply but I wanted to add that some employers are not bound by FMLA rules. They have to meet certain criteria (i.e. # of employees at a location) and you have to have been employed by the company for a certain length of time. If you work for a small company or a company with "virtual" offices, you may not have protection under FMLA.
