Soo DH NEEDS to find a new job, his job cut his pay and dropped him back to a lower position because hes got too much going on and having problems staying focused with me being in and out the hospital (they didnt come out and say this but  I KNOW that is whats on his mind and they claim his job performance isn't where it should be) anyways the insurance already covered my surgery and all that fun stuff. If he switches jobs and we keep continuous coverage through cobra or his other benefits kick in immediately can they refuse to cover my WLS follow ups and all? I'm not even 3 months out yet so I can't just not have my follow ups. I was just curious because I have a bunch of medical conditions and I know if we go without coverage they can refuse to cover treatments because of pre existing condition but I thought I've read somewhere if theres continuous coverage that they can't say it's pre existing.

If you've had existing coverage for more than a year without a lapse of more than 63 days then your new insurance can't deny for pre-existing. If you have not had coverage for a year or you had a lapse of more than 63 days, they can deny for up to one year for pre-existing, but you get credit for the time that you did have coverage. You'll need to obtain a letter of credible coverage from your present insurance company to send to the new one. It is against federal law to deny for pre-existing if you meet the requirements above and it is also illegal to deny for more than 1 year (for group insurance, that is). However, if you have any complications directly related to your bariatric surgery, they CAN deny if that is excluded on the policy. You'll just have to check the "exclusions" section of the policy plan booklet and read the verbiage very carefully. Hope I helped.

Thanks so much for your reply. I've had insurance for 3 years now and never lapse (I had double coverage for a while after I got married). We don't know where hes going to get a job at yet but from what I hear in Indiana WLS has to be covered or something like that is what someone said but I don't know if I read it right or whatever.  Now if a company covers WLS does that mean they will have to cover my complications? I'm so new to this so I have no clue.
