Gary...anyone...Question regarding ERISA???
I've been denied 2x for my brachioplasty. As stated in my denial letters I have rights under ERISA. I have sent in information stating that I have lipedema with lymphedema in my arms, these are congenital conditional which cause the large amount of excess skin and therefor it's reconstructive. I've sent pics of rashes, prescriptions, PCP notes documenting neck pain...everything. When I get my denial it does not address the lipedema claim. No mention at all. I feel they are ignoring part of my claim. Should I go ahead and file suit siting ERISA, or do I need to exhaust my appeals with them? Can I do both?
I have Lipedema and Lymphedema. I also have a passion for Obesity and Health Insurance Advocacy.

My plan covers reconstructive surgery needed due to abnormalities of a congenital condition. It's BCBS doctors that are ignoring the diagnosis and making the decisions.
