I filed a claim with the short term disability company that I pay for through work and they denied my claim.  They say it is denied because "Morbid Obesity is not an illness and Gastric Bypass surgery is high risk elective surgery."  Please help!!!  What do I do next?  I am too weak to go back to work soon but will be on skid row without the money.

FYI the name of the insurance company is Standard Life and Casualty Insurance Company.  I pay $40.00 a month for this so -called insurance.  They didn't even send me any information as to how to appeal it or anything.  Does anyone have them and does anyone know how to fight this?

Now I am concerned. I too will be using disability... When I applied for my FMLA, I was not advised that it would be considered this way, but if this happens in my case I would place my finances in a very bad way...

Okay, so I went on my employer's employee benefits site and logged in and printed and read my coverage and THANK GOD, there is no exclusion. My coverage plan went through all the details of the coverages and the claims process, including appeals. Do you happen to have your plan paperwork. It should have been specifically excluded in advance if they had a leg to stand on... I pray that things work out and that God provides for you during this rough time. The money that my family has already spent this month has been very great and I know that we would be hurting if we had to have 4 weeks of no pay from me!

Was your surgery covered by insurance, or were you a cash patient?  I would think that if your group insurance covered your RNY as medically necessary then your short term should also be covered.  Maybe they just didn't get all of the information.
