Need Some Advice

Let me set the stage here. Long story but my insurance company is fine to approve my surgery. My employer is making me have a 6 month supervised diet. The catch is that no one told me that and they should've a long time ago so I'm appealing it. (but I started the diet anyway in case it doesn't work)

Ok, so I FINALLY got the appeal forms today and I need to fill them out. I've written just about everything you can imagine EXCEPT a letter like this. Obviously I need to try to keep the emotions under control so swearing is probably a bad idea, but any advice you guys and gals could pass along would be a HUGE help.

This patient has experienced varying degrees of success with each of these plans but, to date, he has not found any sustainable results using these traditional methods.

 

Mr. LAST NAME came to me in June of 2008 through a family referral seeking support as he was beginning the process of obtaining surgical intervention to aid him in his life long struggle over obesity.  He was interested having the LapBand procedure done and I offered my support. At the time of our first meeting Mr. LAST NAME weighed PRE DIET WEIGHT and had a BMI of PRE DIET.  With the aid of a registered dietitian and Weigh****chers, Mr. LAST NAME has made some notable strides in his latest weight loss effort. He and I agree that it is imperative that he continue on his current path of success.  We also agree that in order for him to achieve sustainable results it is medically necessary for him to proceed with his original plan for surgery. He has expressed both a healthy knowledge of the LapBand procedure and true expectations of what that procedure can offer him.  Mr. LAST NAME has also demonstrates a knowledge of the weight loss process and seems committed to regaining control over his obesity.  For these reasons I feel that Mr. LAST NAME is an excellent candidate for this surgery and could only benefit from the out come.

Two things...

1) Write the letter you want to. Cussing and all. Then write the letter you need to. It's very theraputic to write the first one and clears your mind for the second.

2) Why does your employer give a crap about a diet?

That is the same thing I asked her a while ago.  Isn't that against the law?? Something is fishy with that whole thing.

LMAO btw.....great idea to write to sep.letters.  I should take that advise because I have a mouth like a sailor.

I had to write a letter of apology once to a guy who flat out lied about me to my boss. I wrote two letters. One I told him what an idiot he was and I was sorry he lied. The other I was a good employee and wrote a good one. I also made sure the first one was put away and I sent the right one. Would have loved to send the first one tho.

i think it's also important to write that once you heard about the employer requirement, you began the regimen right away because of your commitment to your health and seeing this process through successfully. your lack of compliance was not due to your unwillingness to undergo a six-month supervised diet, but due to a miscommunication. had you known about the requirement when you began this process, you certainly would have abided by the policy. you feel strongly that since you have met all the other expectations, the employer should waive this one requirement so that  you may proceed with your plans to have the surgery on schedule, allowing you to recuperate and return to work as a more effective employee as soon as possible.

Sal, I may have to copy and paste your wisdom lol You hit the nail on the head with that one.

And believe me, there has been a lot of journaling on this that included a lot of sailor blushing language. That's not a letter so much as a angry lesbian paperback.

Everyone I've talked to has the same opinion - why in the world does it matter to my employer if I do the 6 month diet? Can they do it? My boss actually called it incredulous. (and if you're feeling an uncomfortable urge to go look that word up, you're not alone. I couldn't tell if he was calling me a liar or our employer stupid lol) I actually considered talking to an attourney who specializes in obesity discrimination cases but I'm really concerned that if my HR department got a letter from an attourney, I'd be out of a job. Just about anyone can tell you that this isn't a good market to be unemployed in. That's a moral debate that I think I'll still be engaged in even after this is over.
