HIPAA is federal law.  A violation of HIPAA is a reportable crime.  The thing to do is report the violation to the HHS.

Innapropriate?  Please.  Its a law.  According to Kimberly she has asked for help from other providers to get the documents.  She asked for help.  These are suggestions.

FYI- someone took it upon their self to post a second thread about this issue- if you read the first entry it is a link to the original post.  Kimberly herself did not start this thread.

And you all seem to assume that someone taking a person to court is just crying out because they have been wronged ...the "sue happy" people you have in mind are likely the ones who won't try any avenue to get what they need.  All I am saying is if you have exhausted ALL avenues to get the necessary documents then you will likely need to seek legal counsel.  Plain and simple.  Since she is asking on what to do? Not inappropriate IMO.

I posted in respose to Truckdrivinmomma who asked why Larissa suggested legal support.  Where are you reading?  And the original response about legal support was part of the suggestion made to Kimberly.  So no, it was not my question being responded to originally.  I was simply making a point- my question was a rhetorical one that someone felt the need to answer. 

I am not trying to make this some kind of war of the words here.  I made my comment known and now it appears to me that you feel the need to attack me on what I had to say in response and taking my responses out of proportion here.   I have no ill feelings toward anyone and their responses.  I simply made a comment back in support that legal counsel could be necessary - but that would be if all else fails. 

I think I am intelligent enough to know Kimberly is an adult and makes her own decisions.  I think bottom line is that people are just concerned when things aren't getting done and someone feels sick and I know that you agree with that one.

This board is supposed to be about helping others. Sheilagh and I are both fairly new to this board. I think that I have posted a question one time. I was attacked and berated for my ignorance instead of being helped. People seriously need to take it down a notch. AND PEOPLE RE-READ THE ORIGINAL POST BEFORE RESPONDING. This would clear up a whole lot of silliness...This is ridiculous. I would have to agree with Sheilagh, if a patient has done everything possible to get the information she needs, she needs to take additional steps. Not everyone has the entire day to sit at their Dr.'s office waiting on the necessary paperwork. We live in a day of technology, they should be responsible enough to comply with the request to fax, email or send a copy of whatever docs one may need....

I think we are talking out of turn here.  She would have needed to request the records in "writing" then the doctor has a certain amount of time to respond.  She would also need to pay the fee etc. before one could conclude that the doctor is out of compliance.

 I'm not an Elariny patient, but my thoughts, from how I perceive her posts and her recounting of events, and without seeing an operative report, is that this sounds like a gynecological issue.  He's a bariatric surgeon, not a gynecologist.    It would be appropriate for him to refer her to whatever specialist that he feels should be treating the problem.   I do hope others weigh in here, though.

Right, it would be real nice if that gyno could have a copy of the SURGERY REPORT. THAT is were I am faulting Dr. E.
