assault and making criminal threats

More details of the beating from http://www.people.com/people/article/0,,20263126,00.html

According to FOX 11 in Los Angeles, which claims to have obtained the notes from a search warrant in the case, Rihanna, 21, read a lengthy text message from a woman on Brown's phone, which led to an argument. Brown – who has a standing court date Thursday – allegedly tried to force his girlfriend out of the Lamborghini, and hit her head against the passenger window.

Brown, 19, then punched the singer while still driving, according to the detective's notes, and blood filled Rihanna's mouth. He allegedly told her, "I'm going to beat the ---- out of you when we get home." Rihanna called her assistant and left a message saying, "I am on my way home. Make sure the cops are there when I get there." The police notes say that prompted Brown to reply: "You just did the stupidest thing ever. I'm going to kill you."

The report also says that Brown bit Rihanna and put her in a headlock, and that she almost lost consciousness.

I was just about to post this!  Also, if the rumor mills are true (about the two of these children getting married)...then does that mean that she doesn't have to testify against him? Did they think that would fly and that the folks would not charge him? This is just a hot ass mess!

I've heard rumors about a marriage and also a pregnancy, but not from any credible sources.  Time will tell, I guess.

I think she would still be subpeoned to testify as they were not married at the time of the incident.  She can't just drop this - a) its too high profile and the DA isn't going to let it go away and b) because of the fear and intimidation factor involved in most true Domestic Violence [DV]cases - DA's sometimes put a lot of pressure on the victim to testify in some cases threatening to charge them with making a false police report or obstruction or some other such charge if they don't.

Several years ago I used to represent folks in DV cases -I  initially was surprised at how easy it is to get somebody arrested for DV- if you are a something of a drama queen with no conscience and an axe to grind you can get a guy arrested for DV.  On the typical court day -  It seemed 1/2 the cases were arguments already resolved between couples - the other half was just scary.

And Rhonda..that's the scariest part of it all...the reconciliation of the victim and perpetrator...just makes no sense!

I know and have heard of women (and men) who will get a person arrested - just because - due to an ax to grind, etc.  Similar thing happens when women 'choose a man' to be the baby's daddy, knowing full well that he ain't (or the possibility of it not being true), but yet..."I'm 1,000% sure - he's the baby's daddy...uh, yeah, right!).

Brown was initially charged with making criminal threats, but will learn whether he’ll stand trial on charges that carry a heavier penalty. Worst-case scenario for Brown, he’ll face felony domestic battery charges and be arraigned today.

However, it’s possible that this case will never get that far. According to E!, Brown’s high-power lawyer Mark Geragos met with the D.A. on Monday to discuss a possible plea deal. Under the terms of the proposed agreement, Brown would plead guilty to a misdemeanor and avoid jail time — the best-case scenario for his career, as he’d avoid the drama of a public trial.

The D.A. had initially sought evidence Brown committed a felony, and at first it seemed like Rihanna would cooperate with the investigation. But given the reports that Brown and Rihanna reconciled and reunited last weekend in Florida, it’s unlikely she would testify against Brown, leaving the district attorneys without their lone witness to the crime. However, since reconciliation is a common occurrence in domestic violence cases and the victim often refuses to testify, the D.A. could use Rihanna’s crime scene statements, as well as that “shocking" photograph of her facial injuries and other evidence gathered the night of the altercation in place of her taking the stand.

So how did word of the couple’s reconciliation hit the streets, anyway? Page 6 is reporting Brown and his camp alerted the media themselves. “Chris tipped off the photographers. He needs it to be out there that he and Rihanna are back together," a source said. “His only chance for a career was if she got back together with him, and he wanted people to see them there." A rep for Brown said, “To my knowledge this is not true."

Honestly, I'd never even heard of Chris Brown until the day we first saw the news story and the kids just gasped in disbelief, "Oh no, not Chris Brown!"  I was like, who's that?   I don't particularly care for the hip hop music - I'm old school.

I've been following this story because we have two girls at home and I know they're going to hear the gossip at school.  I just want to make sure that I'm prepared for the discussions that we'll need to have about this subject of domestic violence.
