Leave/Time off from work for surgery

Hello BAF,

Yes I'm officially back so here I go rapid firing questions again, lol.  I hope I haven't asked this one already.  When you all went out from work for surgery, did you file a short term disability/ FML claim for your time off, or did you use Vacation/Personal time off?  I have pre-planned all my vacation time for the year, and it just dawned on me, I may need to preserve those days unless I can file a claim.  Thanks in advance for the info!!

I filed through FMLA...now I still had to use my sick time.   After 30 days and exhausting all my sick and vacation time my short term disability would have kicked in  paying me 60%  of my pay and that would have been at the company's cost.

Now when I took off for a surgery in the past (different employer) I did have to fill out the FMLA papers but I did not use my own time the company paid it... However I did only receive 60% of my  pay and I could take off 12 weeks!


One of my close friends used vacation time b/c she did not want anyone to know about her surgery!!!!!

Hi,
I used short term disability. I had RNY and was off for 3 weeks, even though I could have went back sooner.

It honestly depends on HR's policy and how it governs time off. I had to use FMLA if I was going to be out more than 2 days and didn't want to take vacation time. So while I was on FMLA my sick time was being used and then once my sick time was exhausted I would have gone to my vacation and once that was exxhausted I would have still been on FML A but it would have been unpaid. I didn't have my employer sponsored STD but I had my own through AFLAC which paid me beginning on day 7 for the remaining 14 days I was out that had nothing to do with my sick leave.

But if i would have had STD my STD time would have still not been activated until all sick time and vacation was exhausted and then it would have paid for up to 26 weeks at 55% of my salary.

Some companies may allow you to take STD and not touch your other days however there is usually a 7-14 day waiting period on all STD policies and unless you have enough sick/personal days to cover that waiting period it still may run into your vacation.

I going to take vacation time only a week. I work at a desk so I think I should be able to make it to work after that.

I'm currently 4 weeks out and took 6 full weeks of FMLA/STD.  Under my employer's plan, STD runs concurrently with FMLA and I am paid 100% of my normal salary.

I chose not to use FMLA.  I had a decent supervisor who only asked for a doctor's note stating that I needed to be out.  I was able to use annual/personal/vacation leave that I had accrued and saved.  I took off 3 weeks.  I also had 2 weeks of sick leave available to me.  If I needed to use more time, I could have filed for FMLA.

I ask the doctor how much time off I would need he said 2 to 3 weeks, so when they asked how much time I wanted I said 4 weeks to be safe. When the doctor's office sent me the paper work it was for 6 weeks. So I'm taking 5 weeks FMLA sick leave.

I have been off of work for 6 weeks and go back tomorrow...I could have been back in 4 weeks...I used FMLA/STD and was originally going to have open RNY..Thank God I did not...and for that reason I was going to be out 8 weeks...My STD paid 67% after a one week waiting period...which I used sick time for...As suggested in a earlier post talk with your HR dept to find out their procedures.
