I find it difficult to believe that someone who is close to a BMI of 40 needs any help *gaining* weight.

Qualifications for insurance generally follows these rules. BMI under 30, not qualified.

BMI of 35-40 qualify if they have 2 or more co-morbidities, like high BP, diabetes, sleep apnea....

BMI of 40 or 100 pounds over weight automatically qualify.

Call your insurance company and verify their rules.

I had the same issue. I was about 7lbs below a 40 bmi. My entire life has been dealing with large bureaucracies like insurance companies and I had no doubt they would not approve my wls unless they could check the box. I went thru the 6 month supervised nutritional consults but continued to eat as normal (the same way I became MO). I also slouched when the nurse took my height to make sure it registered short as possible. The insurance company still denied the first request even though all boxes were checked, and then approved on appeal.
