So my brother was recently denied a job do to his weight. The person who interviewed him flat out said that he's huge and that he was concerned about hiring him and him getting hurt and being left with workers comp costs, or healthcare costs.  I told my brother to file an EEO complaint, he did. Well the case was decided in my brothers favor! This is in NY so I'm not sure where he goes from here-- they are asking what he's seeking. I forget if he had an attorney (in Philly you don't need an attorney to file an EEO complaint.) I'm gonna to ask some labor attorneys I work with for insight-- I have an idea but would love thier input.

He's lucky they told him why he was denied, most companies probably would probably not say it flat out like that knowing that it would be discrimination, however on the sly they probably do it all the time.

That is CRAZY! That hiring manager should be fired. Just speechless that he would actually say that!

I think this was a small family business, which is probably why the person felt so comfortable being honest about why he wouldn't get hired.

What he wants is "A JOB" maybe that is what he would ask for.

IN the very least, a years salary AFTER attorney's costs..

My brother just moved from NY b/c he couldn't find work-- so a job through this same company isn't an option. .I agree a years salary, plus moving expenses and the value of medical coverage he would have had if employed...

I think they should also pay for WLS if he chooses that option.

Wow, good for him. I'm shocked they told him why - I saw you say that it's a small company so I'm guessing they didn't realize the implications there. They definitely need a lesson in HR rules!
