I had to wait on my surgery tooo....fired the doc at the pre-op because she went off on me in the exam room over some very trivial stuff.....had to start over....had a MUCH BETTER doc and soooo glad things happened the way they did in the long run....hope for the BEST outcome for you...i would at least register a complaint with the insurance commission in your state if you have any proof at all you were misled....good luck.....

Sorry to hear you had this issue, but I don't take anything for granted, or have anyone do my leg work for me, even if I see the info on the website, I call in a play "dumb" they reps are so nice....I PERSONALLY call and verify anytime we have to see a specialist. Even when I had to get a stupid CPAP machine, I called the insurance company and had them tell me who to go thru. I deal with customer service, that way every time I call there are notes on my file and I get the reps name.... Never had an issue yet. 

Plus my surgeon called and checked my benefits BEFORE my first visit.

I guess It's better that you found out now that they are out of network, I can only imagine what other things they would have dropped the ball on.

I just wanted to add that many other surgeons will take what you have done with this surgeon and not make you start over. So things like your 6 month diet plan and all that stuff they will most likely take. Just ask them. I had to go to a different surgeon because of my insurance but I was so mad I waited two years. My current surgeon that did my surgery said that if it had been with in a year they could have taken everything I did.

Agreed. Have the old surgeon fax a copy of your records to the new surgeon; the insurance company (likely) doesn't care who signed off on any pre-certification requirements, and test procedures and results are the same no matter which doctor orders them.

I think that I would at least talk to an attorney about misrepresentation. Perhaps you can get part of your money refunded.

I am very sorry that this disaster happened to you but you should probably try to get over the "red hot mad" emotional stage ASAP - I doesn't help when trying to thing logically and legally.

It is your responsibility to go to doctors who are in network if you cannot afford to pay the difference.  Why did you go to this doctor in the first place if you checked him out with your insurance carrier and they told you he was out of network?  Oh wait you didn't make that call.  I bet you do in the future.  Life lesson here.
