Ever heard of work comp covering WLS?
I had a serious back injury at work and have not been able to work for over 2 months. An attorney told me that if the treating physician would make a statement that WLS would be the best solution in allowing my back/hip to heal, work comp would have to cover it. He warned me that they would fight it but it is definitely 'winnable' in court.
Anybody ever heard of this situation?
Tina,
I am a HR manager so I deal with Workers comp alot. It seems unlikely that workers comp would cover WLS as a resolution to a work related injury. I am sure they would fight it. Your doctor(an orthopedist) would have to say that WLS not weight loss in general was your only (prescribed) treatment option and then you would need to be able to prove that your weight didn't cause the back issue( pre-existing condition) that they work accident did. There is alot of room for the Workers comp carrier to find an out.
Good Luck,
Tara
