In most cases that would be decided by a judge..and it can't be done just out of spite. Not now a days.  Rights are usually terminated because of threat of abuse or abuse or abandonment and or adoption of stepparent.

I can only imagine there would be NO attorney general's office needed if it was just that easy to terminate parental rights for non support. 

Have her go immediately to the AG office to open up a case on him.  She could also visit the website freetexasforms.org and read up on what she would need.  forms ARE provided if she wanted to do her own divorce, BUT its usually recommended if there are children and property involved that she hire an atty.  Tell her to check her local Texas Rural Legal Aid OR if she can afford an atty. look up attorneys in the yellow pages, find the ones that deal w/ family law and look for the ones that offer "free consulations" . They will see you one time for free.  At that meeting they will tell you what ur options are, some offer payment plans, others might tell her what she needs to do or refer to other atty....
