Work Stress

So, I have not went back to work yet because Dr said we would talk about it on my next visit.  So, I see him this week and I am having a lot of issues with nausea.  So, I called work today for a phone number and was asked what I "anticipate" to happen.  Well, how would I know...I am not a Dr.  Anyhow, as the conversation went on it was stated to me "I have concerns with keeping the position open after the six weeks"  I felt like I was being threatened due to something out of my control!!  And what am I supposed to do if he wants to test me or something and Won't release me??  And though plans are in action to remove this person from the business  (it is a SMALL place but we have a board and they and staff want her out) there would be nothing anyone there could do about it.  So...tell me how much sense this makes.  The fill in would be gone and I would be gone (if she fired me) and there would be NO ONE in my position while they interview and look.  Please.  I know she is not doing anything drastic and it is all stress talking, but to put this stress on me when I am Already stressed is so not fair.   I totally understand this is a business, etc but I have NOT been contacted in 5 weeks to inquire anything.  I did not realize the replacement was Done at 6 weeks.  Then to blind side me like this When before I Went out I was told..."Oh, I see you out until September"  Well...so you say that then and then screw me now??  I SO hope she gets what is coming to her and they boot her.  I am ticked!!  And mind you, I would be back if I could!!  I cannot afford to be out this long.  DH is working two jobs!  DO they think I am in Jamaica??  Anyhow...just wanted to vent...not many people to whine at about it.

I believe by federal regulations you can be on FMLA for 12 weeks (job protection only, NOT paid) without fear of losing your position.  Or, they have to offer you another position within the company if you return within the 12 weeks.

And, by the way, if this person is a boss of some sort, supervisor of you etc it is illegal for them to ask you when you will be returning or what your doctor is doing or tests or any other information.  You do not have to release that information to them at all.

Good luck dealing with the jerks, wish I had some clear cut answers for you!

I agree with Pam--It is ILLEGAL for them to ask or question you         about a medical procedure it defies the HIPPA (??) law and regulations I believe.  Plus if you need to if you have not done so already go on FMLA and then they can not threaten to fire you or anything.  This all sounds very shady to me and you may want to call the proper authorities to launch an investigation if necessary--document everything from here on out--have all your med info and documentation ready if necessary.  But I am seriously an over cautious woman and may be over stating it--but it is always better to be prepared in my opinion.

If you have an HR dept utilize them and not your boss.
If this is your HR person then shame on them, they are breaking all kinds of rules

I work for a small non-profit.  The Executive Director (the one we are trying to boot) gets to call all the shots as far as hiring, firing and raises.  We have 10 employees so we do not qualify for FMLA.  She is the HR bascially.  LOL  

I did not know about her not being able to ask me that.  So, if I discuss with him I want to go back on say July 8th and I call and tell them he released me for July 8th...they are not allowed to ask if that was His decision or Mine and not allowed to question me for more than a release?  And what if he needs to do a procedure or something?  Do I have to document that for them or just get a tentative release date?  I have to have some idea, just to be kind if nothing else, on Thursday after I see him.  I don't have to give the why or what is going on?  Because I will be vague on purpose if I can legally just to get her panties in a bunch!  LOL

Again I don't think you have to answer any question about what procedure they might need to do, because it would be related to HIPPA law.  As far as answering about if he released you or you requested that return date, who's to know, you get a note from him giving you the ok to return on that date, they need not know it it was his decision or yours.  If they want to fire you, do you think they want to pay unemployment benefits?  I think not.  I am not sure if they are allowed to contact you while you are out sick.  There has to be someone over this person who is your boss.  I would have to take it to a higher authority if things get ugly.  Try and relax (easy to say, hard to do)  Take a deep breath and try not to let them get to you.

Thank you!!  It's nice to hear I am not NUTS for being worked up about it!!

I have decided whatever the outcome, I am going to have them Fax over a note and then I will not call her until Thursday afternoon....then she will have read the note.  IF she questions me I will tell her I have done my part and got the statement from them.  

And yes...I did not even consider the UE thing...they would not want to do that and I can tell you I would be filing quicker than they can think!!  

I do have someone WAY over I can go to...the Board President and he is fantanstic about listening and she is already in very ho****er with him so maybe I Will call him on Thursday if I am not satisfied.  I am an easy gal to get along with, just don't try to get pushy with me when this is not my fault!!
