Disability claim rejected!

Hi Everyone, I am wondering if any one else had trouble getting NYS disability while they were out of work for their surgery. My surgery was 10 weeks ago. 1st the home office of the company I work for never got my disability papers, then I got another statement from my DRs office and faxed it myself to the company. THe next thing was the place that handles our diability insurance wanted "operational notes" from the surgeon. They got those and yesterday I got a letter saying they were rejecting my claim because it was not due to an illness or injury. I can appeal it but I just don't know what to say in the statement. I've been back to work since April 11th so I'm back to getting a regular paycheck but jeepers! Any one have this problem with disability? Patty

Patricia, Sorry to hear about the hard time you are having with your disability. It seems like they need to be convinced that this was not a cosmetic surgery - that it was necessary as a treatment for morbid obesity. Along with this site, I have also found (www)gastricbypassfamily.com to provide helpful information in a more user-friendly format. Perhaps this link: (http://www)gastricbypassfamily.com/Insurance.html can help you with the wording of your letter of appeal. I'd also ask the surgeon's office and your PCP's office as well. Perhaps you may need to submit a copy of your letter of medical necessity to the disability area as well. Good luck.
