OT: New to NY, divorce info needed
Hello Denise,
I sent you a message through your profile with more in-depth information. But just to give you an idea - you do not have to file a separation agreement in NY. NY does require a party to have GROUNDS for a divorce. However, one of the "grounds" is that the husband and wife lived apart pursuant to a decree or judgement of separation for one year or more before commencement of divorce action. So you may file a separation agreement. I am not a lawyer and am not practicing law here - just sharing info that anyone could find out. (Gotta cover my butt). Please check the message I sent to you with more info. Good luck!
