Temporary Disability

Did everyone who had RNY and took time off from work get temporary disability here in New York?   My surgeon's office tells me to get the paperwork from my job and they'll get it all filled out and sent in.   I just assumed that this was standard procedure, but now someone else has asked me about it and I'm wondering if I'm wrong?  Please share your experiences with disability processing and payments.

I was only out for 8 days and used my sick time.  Then again, I have a desk job. Are you having the laproscopic or open procedure?  What type of work do you do?  Any heavy lifting etc?

I'm having LAP-RNY and I also have a desk job.  My surgeon's office recommends a minimum of three weeks off from work, but I've heard he'll okay two weeks if you have a desk job.  Either way, I'm going to be out of work for a minimum of ten days and I can't use any personal time (doesn't accumulate for me until until one year and I've only been there nine months.  I could survive without the income, but if the doctor's office is correct and I can have disability, then I'll certainly take it.

I went back to work after 2 weeks for a desk job.

Regarding the disability, at my old job, when I knew I was going to be out for a big surgery that might have gone over the rest of my sick time for that year, my HR dept. automatically gave me short-term disability forms to give my doctor. So I guess that's what your doc is doing with you.

yup, that sounds about right. If your employer doesn't mind having you out, do what you have t o do. Although I did go back after 2 weeks, I wouldn't have minded a third. If you drive to your job, it will be easier, as I take the LIRR & walk to 26th & B'way. The 1st couple of days, I took a taxi one way. The fact that this past week had a day off in the middle helped a lot.

Hello, I do Workers Comp for an insurance company. I know that as of 7/1/07 the NYS laws for WC have changed. This is NOT a WC claim, but I think the standard is 5 days of your time and then disability (be it short or long term) should kick in. I agree. Check with your HR department. I always tell my claimants that they are responsible for obtaining the paperwork necessary and I will assist with what is missing or not poriveded... For your own benefit, check with your HR as being well infomred is your best option. It can get tricky. Good luck!

But worker's comp is meant for job related injuries, it's different than temp. dis.  I'm pretty sure that you get temp. dis anytime you're going to be out of work for more than a certain amount of time due to medical reasons.  I'll be finding out for sure pretty quick.  Thanks!

I was out for 2 1/2 weeks.  After the 7th day out of work, my employer sent me the paperwork for NYS disability.  It's retro, so even if you are out for a short time, they still pay you for the time you were out.  I even used my sick/vacation time that I had saved up, and still got paid from the state.   Molly

Gastric Bypass Surgerty falls under STD.  This benefit depends on your employer .  If you work for a company with more than 50 employees your employer has to offer short term disability.  STD can be paid in a % or you can just receive the minimum which I beleive is $180 per week?  STD kicked in after the seventh day.  The five days M-F you can use your accumulated sick or vacation days to cover what is called the waiting period.  My employor has a great STD where they pay after seven day waiting period 100% of my salary for each year I work for the company plus one.  So I was scheduled to be out for four weeks.  I got 100% salary.  After the set amount of weeks it drops down to 60%. If you employer does not have this benefit I beleive its a standard $180 per week.  I would double check.
