My day in Court, Finally!

Just wanted to say I finally get my day in court to modify my divorce decree so that my deadbeat ex can no longer screw me over!  I have been at this for 2 years and it is finally gonna happen.  My first attorney took my money, strung me along, and then poof!  he was gone.  I have one now that is doing it pro bono, bless his heart.

Dec. 3rd is my day, wish me luck that he does not try to fight it.  If he does, it will NOT bode well for him, because I will not play nice at that point, and right now I am.

Good luck Kelly on your court hearing for your divorce. Sorry it has taken so long for you. I too went thru a divorce, its no fun & the false promises from the ex-spouse really suck too. So I wish you the best on your court date.

Thanks guys!  But, for clarification - I have been divorced since 2002 - which is a good thing!  I am having it modified, because my ex and I are not following the decree and things have all changed, yet HE gets the benefits and I get hosed!  lol

I am changing the following - in the decree it states:

Kids live with him -   they all live with me and have for 3 years

He carries insurance - NOPE - I carry insurance and have since 2004

I pay him support - NOPE - I have not since the youngest came to live with me in late 2003 and I put all the kids on my insurance.

HE claims the 2 youngest on taxes - I claim the oldest.  Well, again, I support the kids 100% on my own, he contributes nothing, therefore, he should not get to claim them on taxes.

That is it in a nutshell, and if the judge decides to give me child support, OK, but I am not asking for it.  I just want it all to be legal and let me claim the kids - as I pay for them and support them.

Their father does not even really know them, he cannot tell you who their friends are, who or what they do on a regular basis.  He cannot even tell you what school they go to or what their grades are.  My fiance and I know all there is to know about our kids, and we are there for them at all times - so ta hell with the ex. 

I am a fair person, and am not after anything, I LEFT him and have no regrets in doing that.

I am part of a lawsuit against the first attorney, along with 14 others.  Hopefully we get him disbarred and get some of our money back, that was a $1,000 that was hard to come by but I did it.  The attorney I have now is a gift from god and I thank him each time I see him for taking my case pro bono.

Sounds like you got the short end of the stick in  your divorce.  Ex's suck, I know, I have one too.  Luckily he has never tried to hose me on the money or custody issues.  I just wish I didn't have to parent my oldest with him.  Good luck!
