I watch too much TV--could you not take them to small-claims court for them not abiding by the contract? You have all the paper work and contracts, right? Stupid is as stupid does---and that sure describes them.  Good luck.  I'm sure that you're a very conscientious day care provider--I wouldn't want your job for ANYTHING! Take a deep breath and don't let morons totally wreck your day for you! (((HUG))) **SUE**

I am a big advocate on FIGHT, FIGHT, FIGHT!!! Never allow yourself to be bullied. THat's exactly what she is doing. Listen to the advice above. It's good advice. And if you need help... you have lots of friends here who can pitch in. You just let us know what you need.  Be strong! Lori

I feel so bad for you!  I have a friend who does home daycare and she got stiffed once from some lady with bad checks....then the lady quit coming and I think she finally went to court to collect and won.

I almost did home daycare but changed my mind - I think I'm glad!

I'm sorry that you are dealiing with this. Those poor kids.  First their parents are divorcing and second, it sounds like mom is trying to impress a new guy.  And from what it sounds like, this new boyfriend isn't good for her at all.  She's lying to you and them in order to spend more time with her boyfriend.  And what do people do at a bar besides drink?  So are the kids leaving with her after she has been drinking? The one thing I'd ask (if you can) is to talk with dad.  Does dad know that the kids won't be in daycare with you?  Is he a reasonable man? The lame boyfriend should have absolutely nothing to do with you.  The issues should only be between you and mom.  They are just a bunch of twits.  Poor kids. Don't argue with mom and if the boyfriend calls or stops by, ask him to leave or you'll call the police.  He is harassing you.  Don't fight with mom but document everything and take her to small claims court.  You don't need a lawyer.  You've now got your head on straight and won't take any crap. Poor kids.   Just remember mom and her boyfriend are twits. Kelly

Marsha! I would make a photocopy of the contract she signed, highlight any pertinent info (like where it says they will have to pay...) and send a certified letter demanding payment within 30 days or you will sue her in small claims court.  (do you know that if you go to small claims court and sue her, she will also have to pay the court fees?)  you don't need a lawyer to do the certified letter part-I had to do this once when a woman stiffed me on the payment for 250 dollars of Tupperware.  It worked like a charm-I had the money within 2 weeks.  Give it a try, at least.  you don't even need a lawyer to file a small claims court complaint or go to claims court.  If you have a signed document from her your chances of getting a decision in your favor are pretty good.  go for it-you deserve to be treated with respect, you are in business for yourself!! hugs- lynn

HUGS!!!  to you.  Not seeing the kids again is the hardest part of daycare.  Good luck -- personally I would just let it go.  Closing the daycare for at least one day to go to court is not good for the other parents.  And you probably have to take time off for filing the papers too. Be the bigger person and let it go.  If they take you to court, you have the contract.  Plus you can counter sue at the time you get served.  Then you can state your case.   XXOO
