Has anyone been denied surgery for the new Maryland Law ( Dec 2006) stating .....Any small business with 50 or less employees do not have to pay for obesity surgery?   If so, have you heard how people are fighting it .... or have any suggestions of what to do or who to turn to??? I would love any advice ....Thanks in advance!

Yes, my insurance exlcudes wls under that law.  I got no where with CareFirst on this, there was no coverage at all.  Luckily I was able to be added on to my boyfriend's policy as his domestic partner and Great-West covers it.  I was approved in less than 2 days.   Unfortunately if the insurance company excludes it I'm not sure if there is a way around it.  You can try talking to your employer and see if they would consider another plan when it is time to choose this year.  Not all insurance companies decide to exclude it just because they can.  Unless Mamsi has changed, they were going to cover mine until my company switched providers while I was doing my 6 month supervised diet.

Good luck! Don't give up!

My primary care MD ran into this as well for herself. Of course her medical practice is under 50 employees. She wanted the RNY. She tried to fight it and got no where. She wound up paying out of pocket for the band. i don't know if the insurance commisser's office might have any suggestions, but it couldn't hurt. Debbie

Hi Ginger,
I didn't have any issues being approved but there is a girl named Kellie who comes to the Crofton Support Group who has been dealing with something very similar if memory serves me. Have you posted in the insurance forum here on OH? I've heard of people getting a lot of info from there. Good luck to you!

Yes she is but I don't think I have her on my friend's list but one of my friend's does...I'll see about getting it and having her PM you. Is that OK?

Not a problem....I sent her a PM so when she has a chance I'm sure she'll get back to me. I know she's been crazy busy lately.
