Need help with a local lawyer!
I had a hearing before the judge last Sept. and he reversed the decision, which gave me the approval for the surgery. However, Medicaid appealed it and said No way. Then it went before the judge again, and he kept with his decision. However, Medicaid again said, No way. Medicaid has 30 days to do an appeal and to it in Circuit Court(this is what the judge said). I received a letter of reconsideration from the doctor who was at the hearing, and it says I must request a hearing before the judge(again).
This isn't what the judge told them to do. I contacted my attorney and she doesn't know what to think or do either. She was told by the judges office that she needed to contact Medicaid's attorney. She called them, but was only able to leave a message for them to contact her.
She told me today to go ahead a write another letter to request another hearing. I don't believe this is the correct procedure, and am going to do it anyway just to be safe. I need to see about contacting another attorney and find out what they have to say. My attorney is with Legal Aid Services. If anyone out there can help me with an attorney(Obesity) in Western Kentucky, I would surely appreciate it very much. I have been searching the Internet and haven't come up with one. Please help me.
My 30 days according to the Medicaid doctor is up on April 24th. The Circuit Court appeal is up on the 14th. I feel if they don't appeal through the court like the judge stated in his final order letter, that I should get the surgery for they goofed up. But I don't know much about the law.

i don't know of any bariatric lawyers in kentucky. If I were you, I would contact Walter Lindstrom or Gary Visco. Gary has had the surgery amd maybe Walter too, Anyhow, they are both well known attorneys here on obesityhelp.com. They both have an extremely high success rate and they both take cases from all over the country. They do all of it by letters, phone calls and faxes. For a reasonable or very small fee which they might let you make payments on. You could find the phone numbers on here somewhere or ask on the main board. There is always someone on there that has used them. Good luck

My attorney called today, 4/4, Tuesday. She told me that she has been leaving messages(Voice Mail), with Medicaids attorney, but she hasn't gotten a call from them yet. I did write another letter requesting another hearing. My attorney said that she doesn't know what to think about all this, but told me to go ahead and write the letter to be safe. Now, again, we have the waiting game. I wish I could talk with the judge, however, since I have a lawyer, she must do that,and she has, and the judge told her to contact there lawyer. I just wish that this would be over for it has been over a year now. I hope I hear some good news soon. Thanks again for the information. Sorry it took me so long to reply.
Not sure if this will help, but contact the Department of Insurance in Frankfort Ky and ask them if they have any idea how to handle your situation. All insurance fall under the DOI. Also, follow through they are waiting to wear you down, write the letter.
How does Medicaid over rule the Judges descision? Once appeals go to this high of a level it has been my understanding that the judge has the final ruling, can you speak with the judge? I would have the attorney follow up with a letter to Medicaid's attorny and request a reply by certified mail, they must respond within a timely manner
