New Medicare rules prohibitive to some extent

Medicare has passed and back dated a new rule covering bariatric surgery. It seems that now a hospital must be certified as a Bariatric Surgical Centre of Excelence before they will cover it. I have not been able to find what makes a hospital qualify for this. NO hospital in the state of Kansas meets this requirement. I am in Topeka. Stormont Vail is aware of this new rule and that they do not meet the standard. I've been told by the director of surgery that there is no plan to ever meet this requirement. St. Francis will not even speak to me about this other than to tell me to call my doctor. I think this is a matter of money. The hospital will have to invest to get certified and they won't do that if they don't think there is any money in it. The closest hospital is in St. Louis. There are none in Nebraska or Oklahoma. There is one in Denver. This is prohibitive because it's just not possible for my wife and I to travel to St. louis for all of the presurgery stuff. Then for the surgery and then for the post operative care. I've already gone through it all once and had a surgery date and less than 24 hours before it was to happen Medicare passed and back dated this new rule. I have Blue Cross insurance as well but the policy specifically prohibits paying for this surgery or any weightloss program of any kind. It has been sugested that I get a Lawyer but I know of at least one person in Kansas who tried that and failed. The door is once again closed.
