OT: Court Update
Well...got to court in plenty of time. It's been a learning experience, to say the least. First, you wait while they call each plantiff & defendant's name. A folder is handed to the plaintiff and you both are to go out in the hall to see if an agreement can be made. Then you take your folder to the clerk, let them know either way and so on (not sure what happens then yet). If only one or the other shows up, they get the folder and just procede straight to the clerk.
I waited while they called everyone's name. Mine was never called. They finally checked and Cindy had called the court EXACTLY 24 hours (as per the paperwork, any request were to be made prior to 24 hr of court!!) prior to court time to have it CONTINUED!! She also faxed them a letter saying that she couldn't take off of work right now because of employment commitments without it being a burden financially...get this...especially with her being a single mother of a handicapped child!! Her 15 yr old daughter has juvinille arthritis but is in marching band, soccer, etc!!! Handicapped?!?!? Then she requested that it be moved to either May 30th or 31st. The clerk rescheduled it for May 30th. How's that for picking out your own court date???? Naturally, MY notice is 'in the mail'!!! Doesn't MY employment commitments matter???? I am SO pissed off!
I called her ex. He loved that 'handicapped child' bit.
Needless to say, unless that b*tch has a money order for the full amount on her, there will not even be any discussion on this. I refuse to accept anything less. So anyway, this crap drags on! At least I know now that she supposedly intends on showing up. On the plus note, each party is only allowed one continuence and she just blew hers! She continued court several times against her ex so I'm sure she thinks she can pull the same stunt now. WRONG! Now if only I can get the weather to cooperate with me....

Thanks. The original agreement was that she was to repay me in $500/month payments. I haven't recieved that for 22 months....so I guess I need to look at it as in what's another 6 weeks. Believe it or not, she's an RN *****nts a home, leases a BRAND NEW car, gets child support for her one 15 (almost 16 yr old) daughter. In her divorce settlement (11/06) AFTER he ex had to pay off her van ($14,000), he also got ordered to pay half of HER debt to me plus half of HER student loans, he also had to give her $16,000 plus $3,000 in back child support. So....how does someone who owes nothing except me manage to spend $19,000 and be financially strapped in less than 6 months???

I can't believe she pulled the "handicapped child" bit,wow, some people will use their children to get out of anything!!
Girl, I am pulling for you that she has to pay up and settle this once and for all. Hang in there meanwhile, and know I'm thinking of you and here if you want to vent- just call me, Sis!!

Thanks. I hope I do better the next round. My nerves really got next to me today. At one point, I looked down and my hands were shaking. I HATE this kind of thing!!
Ellen...Bill is doing better. Yeah! His next appointment is Friday. I think Dr. Price is going to be please with the progress. I know I am.

Plan on having something to show the court of her agreement to pay. For some reason the court (sometimes) believes the wo-is-me stories they hear and if they order her to pay make it minimal because that person is so financially strapped (supposedly). Do you have any proof of her income? Every opportunity that you can show the court that she makes more than what I am sure she is going to claim would be great. I am sure she will give a big song and dance about her disabled child, the financial burden of having a handicapped child etc etc etc to get the courts sympathy. She probably figures they will order her to pay but will try to get them to reduce it or order payments of a minimal amount. Sink your claws in and hold on for the ride.............I'm root'n for ya!

I not only have the emails where she agreed to pay $500/month but also a copy of her divorce papers where SHE had it put in there that she was to pay a minimal of $50/month...which of course, she hasn't been. She is trying to say that it isn't legally binding since I didn't have a signed contract with her...even though it's in her divorce papers. I don't think there is any way she can get out of paying it. She even had it put in her divorce papers that her ex (who is a seasonal minimum wage worker), if her misses 3 consecutive payments to me for the half he was ordered to pay, that he would have to have his home auctioned to pay me in full. How's that for spiteful? But she doesn't think she should have to pay at all..and it was HER that borrowed every cent.
He ex is working with me on this. Actually, I should be glad for the extra time. I'm waiting for a phone call from him now. I think he has abit to say about his 'handicap daughter' that the judge should hear.....
