indiana law question

Hi all I have a question. I just spoke with the insurance lady at my Dr's office and she thinks that in July everyone will be required to have a 6 month monitoring. My insurance currently doesn't require any. And she is under the impression that I will have to so they are setting me up to do that. I've heard people on here talk about this does anyone have a link or know where I can find this new law? Thanks Tina

Tina, It was my understanding that the law stated that IF your insurance company required a dietary monitoring period that as of July it could NOT exceed 6 months. Currently IF your insurance coverage requires monitoring for approval some insurance companies are asking for a range of 8 months up to 18 months. If your insurance company does not require it at this point I wouldn't worry - or better yet I'd call them and ask them if there are any pending changes regarding the change of law. Here's a copy of that change (please pay attention to the latter part of the paragraph as it pertains to what you asked.). SB0266 Bariatric surgery Effective July 1, 2006 Specifies that a physician's duty to monitor a bariatric surgery patient for five years applies unless the physician is unable to locate the patient after a reasonable effort. Establishes certain topics that must be discussed with a patient before bariatric surgery. Specifies the information that must be reported to the state department of health and provides that a report made by a physician to the state department of health of a death, serious side effect, or major complication of a patient who had surgical treatment for the treatment of morbid obesity is confidential. Specifies that statistical reports compiled by the state department from the reported information are subject to public inspection. Requires six months of supervised nonsurgical treatment before health insurance, a state health care plan, or a health maintenance organization must cover surgical treatment for morbid obesity. (Current law requires 18 months of supervised nonsurgical treatment.)
