Can anyone help?
Ok I am 2.5 yrs post opt. Being at goal is great but it doesn't solve all your problems! 5 mths ago I bought a new home, moved out of the house in Troy Il, I owned for 15 yrs, I put it up for sale, well some friends needed a place to live for a few weeks, well I let them move in there. It was not for rent so no contract. Its been 5 mths now! They won't move! Not a dime towards the house payment. The utilities are in there name. 30 days ago I sent them a registered letter telling them to be out by Nov 27. I have verbally asked them to move after being there a few weeks, I kept asking. Now they are refussing to let the realestate lady show the house. Now these 2 cursed me out yesterday cause I am not being fair! They both work and have 2 kids. Where can you stay for free for 5 mths?? They say they are not moving! The broker can't show the house as long as they live there! They have a big dog inside the house. I told them I am moving back Dec 4! Guess we all will live together? ha ha NOT! I am going to the court house Monday to see what I can do! If they are there Dec 4 I am moving a bunch of boxes, yard sale stuff in the living room! I will even sleep in there bed if I have to! Its my house! I will even put old stuff of mine in there! I might even get a new furnace, have the old one removed and the new one be on back order for a few weeks! I don't want to get stupid or bend down to there level! But how can I get them out! How long will it take? I cannot keep making 2 house payments! They refuse to pay anthing! Its a nice house, I never dreamed it would not sell! Well how can something sell if it can't be shown! My landlord went through the same just like 2 weeks ago...I typed up a eviction notice for him ,he handed it to them like 3 days after the rent was due....(this is month to month too)...and they own him $1,150.00 back rent and utilities...
He handed them a 5 day notice...and they were out day b4 the 5 day....I stated on there if we go to court ,all cost would be paid by you ...
and they didnt have a leg to stand on...knowing they havent paid anything and not paid in full when ask...he knew they couldnt win in court....and they knew it too....they were leaches...luring and waiting for him to give a 30 . then another 30 (which would be 60 days.) and then another for the full 90 days notice...well, I used to work in a court house. county clerk in my home town....Salem , Illinois and I knew there were a way around the 90 day notice ...My landlord was pleased that I would go out of my way and help him with this problem....with a low fee of or around $30.00 to $35.00 and this is they lose can be reimburst to you...paid by the (tenants)

if they dont follow this procedure.....take a copy to the court and have the judge to issue for it to be hand delivered by the sherrif....
Could you email me a copy of this eviction notice you typed? Then I will give it to them! I sent them a hand written one registered mail on Oct. 27 stateing they owe me $1300.00 and a notice to be out on Nov 27, 2005. Ok I will give them a 5 day notice now! I am going to see a lawyer this week! I am gonna try to wait til after the 27th to file court papers cauuse I don't want them to think they can stay 30 more days! I am moving back in there Dec 4, if they like it or not! I may just have to sleep in there bed! Yes I will have boxes all over the house! yard sale stuff! Nothing I care about. (1).PAY the said rent(s) in full , to the landlord or its agents ,within 5 days after service of this notice, OR
(2).DELIVER processions of the Premises to the landlord , or its agent(s)...

If you do not pay the rent due and utilities or peacefully deliver processions of the Premises by 12:00 noon on____________,,the Landlord, or Agents will institute legal proceedings against you to declare a forfeiture of your lease or agreement(s) thereof for the Premises,to remove processions of the Premises, and to make claim for rent(s) other agreements or damages.

In ILLINOIS if someone establishes residence with or with out a lease you may have to initiate eviction procedings thru a court order to get them out. (learned from experience) even if they pay not rent and you do not want them there. the police will not even remove them if it is your own residence where you live. unless you have visible physical injuries. It was a law that took effect last Jan.
the moral of the story dont let anyone live on your property unless you are willing to go to court to evict them from the place.. You were really nice and it is too bad it came back to bite you on the butt. they are users and don't desrve a friend as nice as you
Cyndi ... I'm sorry but I can't help with your issue, but I do feel for you, and please know that you've got my best wishes and prayers ... what a slap in the face for trying to do something nice for someone!! It breaks my heart that people can be so awful.
I know you probably can't do anything, but it would be nice if you could have the utilities put back in your name and turned off. How did they ever get them on in their name anyway, without providing a lease? There's got to be some loophole somewhere ... too bad the law protects idiots like that.

My landlord presented this written notice to the tenants that didnt pay full rent...another words they would pay him just enough to stay there and told him each month,they would come up with more later.which never happens...
they did this to him for 6 mo's...and also promised to have the utilities put in their name which they didnt and the landlord kept them in his name and they paid only on the rent...this added up owning landlord over $1,000.00 and when the written notice was handed to them , they moved out and NO he didnt have to have a court order to get them out....unless they dont sign the written notice that my landlord handed them....once they saw this and read it ...they knew they didnt have a leg to stand on....the landlord told them if they didnt sign and go to court that all will have to be paid even though they will be evicted....and on the fifth day if not out he will come in and remove the belongings out...so they didnt want any part of this and moved out in 4 days.....this scared them enough to get out....Now if they dont sign it....then go to court and have it ordered by the judge to be hand delivered by a sheriff....but be sure to tell judge what the reason for eviction,and why only 5 day notice and not 30(60-90) day notice ,this is what my landlord was going to do if they didnt abide by this written notice.....but, it work and they moved out on the 4 th day...
most people who wont pay are not the brightest light in the shed.. I am sure they don't have enough money to get a lawyer with you sending them a eviction notice I would send that letter have them sign and I would take to the bank and get a witness signer, then send it to them they will probally thing they are screwed and leave! I wish you the best metro east and st louis this is all too common!!! I hate this area and can't wait to move out of here.. this place sucks.
