Thanks for the post.  I know I can beat this.  My ins. company actually told me I can by having my doc submit more info.  BTW Dr, Roslin will be my revision suregon, funny you posted that link.

OMG!  How funny is that?!  The reason I included the link is that he specifically states that the
surgery is what fails, not the patient.  I should think he would definitely be one to speak up for
you.

Appeal for sure. It's not uncommon to be denied the first time around.

Definitely appeal! This was my nightmare with my band. I got it so long ago, and had no follow up care here in the US so obviously I had no way to prove that I followed the plan. I was denied on my first try and then approved on my second attempt. Keep trying! I'm so sorry. It is such bull****!!!!! It makes me furious.

I got denied for this. What BS. I did not beat it; I have to sue. Unfortunately, where there is literature about "failure" most published sources just go to "blame the patient" mode without examining the REAL, medical causes. It's a bias.

Just how the heck would they know if a patient was/wasn't compliant anyway? It's blame the victim, plain and simple, but they are getting away with it in many cases.

 Roslin is my surgeon, too.  I happened to be in his office once while he had to take a call from an insurance company about a review and I witnessed the conversation.  Take pity on the person on the other end of the phone.  He will fight for you.

I was denied for being non- compliant.  I am not approved yet, but in my IMR, I submitted a diet and activity journal. Perhaps, try that, if you keep one.
Pre-band highest weight: 244
Pre-band surgery weight: 233
Lowest: 199 ( for, like, a day)
CW:
260 (yes, with the band!) 
Current Fill: 5cc in 10cc band
BMI: 49
