KAISER GOING TO BE SUED!!!

Hi Friends, Don't have to much time to lurk around the board, but I woke up early today. Yesterday, I just hired an attorney to sue Kaiser on behalf of my two year old son who suffers from Autism.  Kaiser has refused to provide a treatment plan for him.  The attorney that I hired, by the way, is one of the best attorneys in the nation in handling bad faith claims against insurance companies.  He was featured in Michael Moore's movie Sicko. He is expected to be filing a lawsuit next week in Superior Court, not Kaiser's arbitration scheme, but in actual court.  He found  Kaiser's  conduct to be so egrerious that they may have forfeited their right to settle their case in arbitration. Before I hired the attorney, Kaiser's lawyer called and asked me to drop the arbitration request, but I told him that I needed to speak to my attorneys first.  He asked for it because, as a result of my son's case, the Department of Managed Health Care is all over Kaiser's ass and the case, according to him, is very complicated. "CRY ME A RIVER!"   The DMHC is ordering Kaiser to provide a special therapy for my son, very expensive by the way, without the need for an Independent Medical Review, the therapy alone cost $70,000 a year! Woohoo!  This I  won by myself without the help of a lawyer. However, things got complicated and it is time to move and compell Kaiser to meet their contractual obligations to their insureds.  To make a long story short, Kaiser has been extremely anal about my son's case, even one of their "Senior Case Managers" laugh in my face when I attempted to advocate on my son's behalf.  Shame, shame, shame. I have good faith and a good feeling that your attorney is going to nail Kaiser good for sure! Someone has to put them in check. Congrats on getting your son therapy.....and keeps us posted about what happens!

Way to go - keep on them.  The HMO's need people like you to keep them in check. I will be sending good thoughts to you and your son that all works out....hang in there and don't give up the fight......

Best of luck to you getting the best treatment possible for your little one. Gosh, I remember when he was born--seems like just yesterday! You're a good daddy for going to the extremes that you have to go through.  BTW, loved that movie Sicko! Very interesting! I've been meaning to rent it again.

Hi Cindy, It seems like yesterday, isn't it?  Like I always said, win or lose, I am not going to go down without kicking and screaming.  There will not be any unsurmountable barriers that will keep me away from fighting for  what is right, specially as far as my baby is concern.  He is so precious and it pains me to see him this way.  However, with early intervention, he could lead as normal a life as anyone else, but Kaiser is not helping and the government is very slow in providing services for children in the Autism Spectrum which what Kaiser keeps telling me to do. No kidding!  You can bet your baby's milk that they have good people...good medicine with luck, otherwise, you are dead!  However, since their game is about money, hire an attorney, like I did, and sue the hell out of them!  They will be listening to me next week after the lawsuit is filed.
