FMLA, where do I get the paperwork to file?

So I believe my employer should have told me about FMLA,but of course the HR gal is a retard.  I'm not even going to say anything, cause it is her job. We only have 6 employees here, but we are a local government agency (City Hall) so I know we are covered under FMLA.  Can I get the paperwork some where online and just file? I don't recall my employer giving me anything when I went on maternity leave 2 1/2 yrs ago, but I remember paperwork coming from FMLA to my home in the mail.

Unfortunatly you are going to have to speak to MS HR.  Your HR dept has paperwork.  My company FMLA paperwork is different than my BIL (who just had to file) and my DS (who also had to file).  If she (MS HR) is unwilling to cooperate and provide you the paperwork go to the link I posted in the prev post and contact the DOL (Dept of Labor) they will be please to help you help Ms HR comply.

When I had my surgery I applied for state disability and my husband applied for FMLA from his work. FMLA is for others to care for you during your surgery time. or for you to care for another family member while they are ill.  double check the law here is the website. http://www.dol.gov/esa/whd/fmla/ I hope this helps, Alice

My understanding is that FMLA can be for your own medical condition or for those of your family members.  Employers with a minimum number of employees have to follow this. You can receive CA DIS while on FMLA because unless you have paid into FMLA that leave is unpaid but it does secure your job as long as you don't exceed 12 week in a 12 month period (does not mean a calendar year) and you have appropriate medical documentation from your doctor. The website  should give all the details.

That is correct. You can use the FMLA for either yourself or for a family member. It covers up to 12 weeks leave. I received SDI while off after surgery and then my job supplemented the difference. Make sure you contact the HR dept...you ARE entitled to it.

If your employer is tripping, then you can get the papers from the HR dept. they can mail to you, or you can pick them up, then have your doctor fill them out and fax it back to your employer.  FMLA is also for your own serious illness...... Annabelle
