I was wondering if anyone's spouse is taking the family medical leave act while they are recouperating from surgery? I wasn't sure if this is the kind of thing that you can use that for and if your doctor gave you a hard time to give it to you?

I really don't see why the doctor would give him a hard time. That is what FMLA meant for. My husband is just using vaction time to be with me for a couple of days, but I had to fill out the paperwork for myself. There was like 6 different catagories to choose from and the first one was having surgery/hospital stay. Probably the best thing to do would be to have your husband call his HR dept. and ask a "general" question in regards to FMLA. I hope this helps! Carrie

I am having open RNY so I will probably need help for a least a week after I get home from the hospital. I just hate for my husband to have to take time off work.

Did he try to call his HR dept? They would be best to ask, because they will be the ones sending him the paperwork anyways. Also, tell him to over-estimate the time he will be out with you, that way if you still need help after a week he has some leeway. That way he doesn't have to go back and ask for more time. And if you are fine before that time, he can go back early. I help all work out well for you! I just sent my paperwork up to my corp. office today, so we will see what they say. Carrie

I am having the surgery done on 8/20, and my husband is waiting for the nurse to fill out the paperwork. They can only ok the time spent in the hospital or a week at the most, and then intermittent after that because I will not be clear to drive for 2 weeks. I do not know if it will be approved by his job however, because I don't have 30 days notice. He has saved vacation for this purpose.

Hope this helps you, I took FMLA when my mother had surgery. I didn't have to take care of her full time but it was approved so I could take off for her surgery and a few days and I could take off for the next 12 weeks if she needed to go to the dr or something else came up.
