Question:
Can you be on disability after surgary till you go back to work? And how?

It my understanding that you can go on a family leave after surgary but it is without pay. I'm sure I am not the only one who can not afford this, is it possible to be on disabilty while you recover till you go back to work? Any advice on where to start the research? Also, Has anyone had problems with their employer when they've gone back? Any advice would be greatly appreciated! Thanks    — ERIN M. (posted on November 12, 2001)

No, I do not believe you can go on disability. This is a medically necessary surgery just like having your gallbladder out -- with about the same recovery time, in fact. You can use your sick pay or even personal leave time, but I doubt you'll be able to go on disability - because it is short-term at best -- unless you happen to pay for such a short-term disability insurance yourself maybe. I had no problems with my employer since it was medically necessary - in fact, my employer is impressed because I now have so much more energy and hardly ever a sick day anymore! Best wishes.

Yes, you can go on short-term disability for WLS once you have used up your sick/vacation time. I went onto disability for 6 weeks after my surgery and received a check bi-weekly. You should have no problems with your employer as this is a major surgery.

YES You can go on disability STD/ I was on it for 6 mos. because of complications from the surgery. It doesnt matter if it was elective or not, it is still a major surgery. As long as your company offers it, it will be a covered disability. Call your companies HR and they can tell you their disability carrier and you can personally ask them.

I've worked in employee benefits insurance for years. If the company you work for offers short term disability, you should be able to qualify for this benefit. It's typically a set dollar amount per week that is paid (e.g., $300) or a percentage of your pay (e.g. 60% to $500). I'm currently on short term disability (STD) and just received my first check on Thursday. It will be reduced but at least it's something.

I am salaried and have short term. I was approved for 4wks, and as I had over 5 yrs in at my job it was my total pay amount and I didn't have to use my sick time or my 4 wks vacation I had accrued. Check with your hr
