Get a Lawyer
Some of you may have followed some of my posts from Oct. To summarize after 1 year of battling ins. co. I was approved in writting for RNY. Two days from surgery my approval was rescinded and I had to cancel. I have contacted Obesity Law from this website, I have been to The Ins. Comm. , I have appealed, lost thousands in income from time off work and have had 4 attourneys tell me they don't handle this type of case. VA will not cover me, I cannot quit, move or change ins. now. I cannot get new ins because morbidly obese people are uninsurable through private plans.
I live in WI. I need help and I need the help that will not tell me to contact an attourney because so far that has been a waste. I contacted state gov. my employer, every possible link on this website and have found no one that can help me as of yet. Does anyone know who I can contact for help to get surgery and at the very least be reimbursed for the 60 days of work I cancelled that I can never get back. I have already looked on the WI website and could not find a route to a WI based obesity law attourney. The one I did find did not take me anywhere.
I know I need good lawyer..... anyone got one working in WI that will take case on a settlement basis.
First, I doubt you will find an atty that will take this type of case on a contingent-fee basis, unless they believe they can make a GOOD successful claim and win at trial for "bad faith" or breach of contract against your ins. co. ..
That aside, you said you can't get private ins. now b/c of your obesity .. Does your state have a high risk pool for such persons, which is underwritten in part by the State? I know we do in Texas. It is the ONLY ins. a lot of people in Texas can get if they have pre-existing conditions like diabetes, hypertension, apnea, etc. It's not too bad, an 80/20 PPO plan with $1K-$5K deductibles .. The plan is allowed to charge 2x the going rate for such coverage though, so it is not cheap .. Here in the Dallas area, as a 46 y.o. non-smoker M, I pay over $350 a month for myself .. But it beats not having anything and the State of Texas knows that, hence why they make it available .. (btw, it DOES have a blanket exclusion though for any WLS or weight-loss related treatment, although they did approve RNY if certain conditions were met for one recent insurance year!)
One alternative that may also be available in your state to get your WLS funded which we have in Texas is to go through the State's workers' rehabilitationi commission .. This is the state agency that handles the training or re-training of employees who can no longer work at their present line because of a physical disability .. Some state funds are set aside here each year to provide WLS to workers who are no longer able to be productive workers b/c of their weight situation .. It's not much (and lately very difficult to find a WLS surgeon who will accept payment from them), but the first workers to file applications after the first ofthe year stand the better chance of getting approved before the money is all gone ..
